Terms of Service

Last updated: 28 October 2026

1. Agreement

These Terms govern your use of Uquest, a fitness and nutrition tracking application provided by UQUEST (Pty) Ltd ("Uquest", "we", "us"), a private company registered in South Africa (registration number 2026/788036/07), with registered address at 62B Justice Mahomed, Pretoria, 0181, South Africa. The office bearer is Kelton Mdakane (Director).

By creating an account or using Uquest, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old to use Uquest. By creating an account you confirm that you are 18 or older.

If we learn that an account belongs to someone under 18, we will close it and delete the associated data.

3. Medical disclaimer

This section is the most important part of these Terms. Please read it.

3.1 Uquest is not a medical service

Uquest is a fitness and nutrition tracking tool with an AI coaching feature. It is not a medical device, not a healthcare service, and not a substitute for professional medical advice, diagnosis, or treatment.

3.2 Q is an AI, not a professional

Q is an AI, not a professional. The AI coach ("Q") is an artificial intelligence system, not a person. It is not a doctor, dietitian, physiotherapist, personal trainer or any other licensed professional. It cannot examine you or diagnose you, and it knows only what you have entered into the app. AI systems can be wrong. Q may produce guidance that is inaccurate, incomplete or unsuitable for you.

Example training and meal plans. Q can write general example training plans and sample meal plans based on what you have logged. Each one is a general example of what a plan could look like. It is not a personalised prescription, and it is not medical, dietetic or physiotherapy advice. Q can make mistakes in exercise choice, loads, sets, repetitions, calorie and macro figures, and food quantities. Before following any plan, check that it suits you, start conservatively, and adjust it to how your body responds. If you have a medical condition or injury, are pregnant or breastfeeding, or have or have had an eating disorder, speak to a qualified professional before following any plan. Stop any exercise that causes pain. Whether to use a plan is your decision.

3.3 Consult a professional

Speak to a qualified healthcare professional before starting any new exercise programme, making significant dietary changes, or acting on anything the app or Q suggests — particularly if you:

3.4 Stop and seek help

Stop exercising immediately and seek medical attention if you experience chest pain, dizziness, shortness of breath, sharp or joint pain, or any symptom that concerns you. Do not "push through" pain on the basis of anything in this app.

3.5 Eating disorders

If you are experiencing disordered eating, calorie and weight tracking can be harmful. Please speak to a healthcare professional rather than relying on this app.

South Africa: the South African Depression and Anxiety Group (SADAG) provides support on 0800 21 22 23.

3.6 You are responsible for your decisions

You use Uquest at your own risk. You are solely responsible for decisions you make about your training, diet, and health, whether or not they were informed by anything in this app.

4. Your account

You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly at support@uquest.app if you believe your account has been accessed without your permission.

You agree that the information you provide is accurate. The app's calculations and the AI coach's guidance are only as good as the data you enter.

5. Subscriptions and billing

5.1 What's included

5.2 Payment

Payments are processed by Paddle, who acts as the merchant of record for purchases. Paddle handles payment, tax, and invoicing, and their terms apply to the transaction alongside these Terms.

5.3 Renewal

Subscriptions renew automatically at the end of each billing period until cancelled. You authorise recurring charges until you cancel.

5.4 Cancellation

You may cancel at any time. When you cancel, you keep access until the end of the period you have already paid for. Access then ends, and you are not charged again.

Cancelling does not delete your account or your data. To delete those, use Profile → Delete account in the app.

5.5 Refunds

See our Refund Policy.

5.6 Price changes

We may change prices. Existing subscribers will be notified before a change takes effect and may cancel if they do not accept it.

6. Acceptable use

You agree not to:

We may suspend or terminate accounts that breach this section.

7. Your content

You keep ownership of everything you enter — your logs, notes, and messages.

You grant us a limited licence to store and process that content solely to provide the service to you, including sending relevant parts to our AI provider to generate coaching responses. This licence ends when you delete your account.

8. Privacy

How we handle personal information, including health information, is set out in our Privacy Policy and, for United States residents, our Consumer Health Data Privacy Policy. We ask for your consent to process health information separately from your acceptance of these Terms.

9. Our content

The Uquest application, its design, branding, and underlying software are owned by us and protected by intellectual property law. Your subscription grants a personal, non-transferable right to use the service. It does not transfer ownership of anything.

10. Availability

We aim to keep Uquest available but do not guarantee uninterrupted service. Features may change, and we may modify or discontinue parts of the service. Where a change is material and affects a paid feature, we will give notice.

The service depends on third parties — hosting, AI, and payment providers — whose outages may affect availability.

11. Disclaimers

To the fullest extent permitted by law, Uquest is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or accuracy.

We do not warrant that:

Estimates such as maintenance calorie requirements are approximations based on population formulas and may be significantly wrong for any individual.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the service.

Our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or any rights you have under the Consumer Protection Act, 2008.

13. Termination

You may stop using Uquest and delete your account at any time.

You may delete your account at any time, as described in our Privacy Policy. Deleted accounts can be restored within 30 days, after which deletion is permanent. Each person is entitled to one free trial. Accounts created to obtain repeat free trials may be restricted.

We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the service. If we terminate without cause, we will refund any unused portion of a paid period.

14. Changes to these Terms

We may update these Terms. Material changes will be notified in the app or by email before taking effect. Continuing to use the service after that constitutes acceptance. If a change affects how we use your health information, we will ask for your consent again rather than relying on your continued use.

15. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.

If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence.

16. General

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and Refund Policy, form the entire agreement between us.
